Terms of Service

These Terms of Service ("Terms") set out the terms between you and GoTamil ("GoTamil," "we," "us," or "our") and govern your access to and use of gotamil.in, our extensions, applications, APIs, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Who We Are and What This Agreement Covers

These Terms of Service ("Terms") govern your access to and use of GoTamil at gotamil.in, our browser extensions, desktop or mobile apps, APIs, and any related services, features, and content (collectively, the "Services").

These Terms are a binding agreement between you and GoTamil. If you use the Services on behalf of a company or organisation, you represent that you have authority to bind that entity, and "you" means the entity.

You must also review our Privacy Policy and any product-specific addenda we provide, such as a Data Processing Addendum (available on request for business customers).

2. Service Description

GoTamil provides AI-assisted Tamil grammar, spelling, style suggestions, rewrites, and related writing utilities. You may submit text and other content for analysis ("User Content"). The Services return suggestions, rewrites, scores, or other outputs ("Outputs"). Outputs are generated automatically and may be inaccurate or incomplete. You are responsible for reviewing Outputs before using them.

We offer paid subscription plans called GoTamil Pro with additional usage, features, or support. Features may vary by plan, platform, or region.

  • Licence to Use the Services. Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the Services for your personal or internal business purposes.

3. Accounts and Subscriptions

Your Account

  • You must be at least 16 years old to use the Services. If you are between 16 and 18, you must have parental or guardian consent.
  • You must provide accurate account information and keep it updated.
  • Safeguard your credentials; you are responsible for all activities under your account.
  • Do not share your account.
  • If you create an account on behalf of an organisation, you represent that you have authority to bind that entity and that these Terms apply to that entity.
  • If the law where you live requires a higher minimum age to use online services without parental consent, that higher age applies.

Pro Plans

  • GoTamil Pro is offered on a paid subscription basis only. We do not offer free trials.
  • Plan features, usage limits, and seat entitlements are described at sign-up and may vary by plan, platform, or region.
  • We may verify compliance with plan limits and take steps to prevent abuse, including throttling or suspension.

4. Acceptable Use Policy

You agree not to, and not to allow others to:

  • Violate applicable laws, including intellectual property, privacy, export controls, or the Information Technology Act and rules of India.
  • Upload content that is illegal, exploitative, defamatory, harassing, hateful, or that contains another person’s personal data without a lawful basis.
  • Use the Services to create or spread malware, scams, spam, or for surveillance without consent.
  • Attempt to bypass usage limits, rate limits, or security controls; scrape or harvest data from the Services; reverse engineer any part of the Services; or access the Services using automated means not approved by us.
  • Use the Services to develop or train competing models or services except as permitted by a separate written agreement.
  • Interfere with the Services’ operation or with other users’ access.
  • Do not submit special categories of personal data (for example government IDs, health, or biometric data) unless specifically requested by the Services and you have a lawful basis.

We may suspend or terminate accounts that violate this policy.

5. User Content and Ownership

  • Ownership. You retain ownership of your User Content and Outputs, subject to third-party rights.
  • Licence to Us. You grant us a non-exclusive, worldwide, royalty-free licence to host, cache, transmit, process, and display User Content and Outputs as needed to provide and maintain the Services, comply with law, and enforce these Terms.
  • No Training by Default. We do not use Customer confidential text submitted through authenticated Pro accounts to train our models by default. We may use de-identified operational telemetry to improve system performance and security. You can request an opt-out or sign a DPA for stronger commitments.
  • Similarity of Outputs. Because of the probabilistic nature of AI, Outputs may be similar to outputs generated for others. We do not promise that Outputs are unique or exclusive to you.
  • Your Responsibility. You are responsible for having a lawful basis for any personal data you submit and for the accuracy and legality of User Content.

6. Intellectual Property Rights

All intellectual property rights in and to the Services—including software, models, interfaces, text, graphics, logos, trademarks, and other content—are owned by GoTamil or our licensors and are protected by applicable laws. Except for rights expressly granted to you in these Terms, we reserve all rights.

You may not copy, reproduce, modify, adapt, translate, create derivative works from, distribute, transmit, display, perform, publish, or otherwise exploit any part of the Services without our express written permission. You may not attempt to extract source code from the Services or remove, obscure, or alter any proprietary notices.

Restrictions

Without limiting the above, you agree not to, and you will not permit others to:

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Services, or make the Services available to any third party, except as expressly permitted by these Terms.
  • Modify, make derivative works of, disassemble, decrypt, decompile, reverse compile, or reverse engineer any part of the Services.
  • Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of GoTamil or its affiliates, partners, suppliers, or licensors.

7. Payment Terms

Billing and Payments

  • Subscriptions are billed in advance at the start of each billing period. You authorise us and our payment processor to charge your payment method for the then-current fees.
  • Fees are charged in the currency shown at checkout.
  • Payments are processed by our third-party payment processor and may be subject to their terms.
  • Prices exclude taxes unless stated otherwise.
  • If a charge is declined, we may retry. You must promptly provide a valid payment method. Failure to pay may result in suspension or termination.

Authorisation for Recurring Payments

By subscribing, you expressly authorise recurring charges to your payment method (monthly, annually, or as otherwise stated) until you cancel. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.

Taxes

You are responsible for any VAT/GST, sales, use, withholding, and other taxes applicable to your purchase, other than taxes based on our net income. Where required, we will collect and remit taxes.

Pricing and Information Accuracy

We work hard to be accurate, but the Services may contain errors, inaccuracies, or omissions related to pricing, plan descriptions, availability, or other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information is inaccurate at any time (including after you have submitted your order) without prior notice.

If we cancel an order due to a pricing or typographical error after your payment method has been charged, we will issue a full refund to your original payment method for the amount charged.

8. Refund Policy

Except as required by applicable law, all subscription fees paid for GoTamil Pro are final and non-refundable. Your purchase of a subscription constitutes your acceptance of and agreement to this no-refund policy.

  • No Refunds for Partial Use or Dissatisfaction. We do not offer prorated refunds for subscriptions that are cancelled mid-billing cycle. No refunds or credits will be provided for partial months of service, unused features, or if you are unsatisfied with the service.
  • Immediate Access to Services. Upon payment, you receive immediate access to the features of your GoTamil Pro plan. Due to the digital nature of the service and the immediate value provided, we cannot offer refunds.
  • Statutory Rights. This policy does not affect any non-waivable statutory rights that you may have under the consumer protection laws of your local jurisdiction. Any refunds required by law will be processed accordingly.
  • Discretionary Refunds. In rare, exceptional circumstances, GoTamil may, at its sole discretion, decide to issue a refund. Such a decision in one instance does not create an obligation to issue a refund in any other instance.

9. Cancellations

You have the flexibility to cancel your GoTamil Pro subscription at any time.

  • How to Cancel. You can manage and cancel your subscription directly from your account settings page.
  • Effect of Cancellation. When you cancel, your subscription will remain active until the end of your current paid billing period. You will retain access to Pro features until that date. After the billing period ends, your account will revert to the free version of our service, and you will not be charged again.
  • No Prorated Credits. As stated in our Refund Policy, we do not provide prorated credits or refunds for cancellations that occur before the end of a billing period.
  • Downgrades. We do not offer the option to downgrade your plan during a billing cycle. To change to a different plan, you must cancel your current subscription and subscribe to a new plan at the end of your billing period.

10. Fair Use and Rate Limits

We may apply usage caps, document length limits, per-minute or daily request limits, or other technical controls to ensure stability for all customers. Excessive or abnormal usage that degrades service for others may result in throttling, plan changes, or suspension.

11. Privacy and Data Protection

Our Privacy Policy explains what personal data we collect and how we process it. If you require a Data Processing Addendum with Standard Contractual Clauses or other regional terms, contact us at [email protected].

  • Retention. We store account metadata for as long as your account is active and as required by law. Text processing logs are retained for up to 30 days for abuse detection, troubleshooting, and billing.
  • Deletion. You can delete individual documents or request account deletion. We will delete or de-identify associated personal data except where retention is required by law or to resolve disputes and enforce our agreements.

12. Security

We implement reasonable technical and organisational safeguards to protect personal data and User Content, including encryption in transit, access controls, and vulnerability management. No method is perfectly secure. You are responsible for securing your devices, browsers, and networks.

  • Security Incident Notice. If we become aware of a breach of security that affects your personal data, we will notify you without undue delay and, where required by law, within 72 hours.
  • Responsible Disclosure. If you believe you have found a security vulnerability, please email [email protected] with details. Do not publicly disclose before we confirm a fix. We will acknowledge reports in good faith. Bounty programmes, if any, will be described separately.

13. Third-Party Services and Processors

Some features may rely on third-party services or models. Where we use subprocessors to provide the Services, we will take reasonable steps to ensure they implement appropriate safeguards and process data only on our instructions. Your use of third-party services may be governed by their terms, and we are not responsible for their acts or omissions.

We maintain a current list of subprocessors available on request at [email protected] and will provide notice of material changes where required by law.

If you download GoTamil via an app store or platform, your use of the app may also be subject to the platform’s terms and policies, which may apply in addition to these Terms.

14. Beta Features

We may label certain features as Alpha, Beta, Preview, or Early Access. These features are provided for evaluation, may change without notice, may be less reliable, and may have different support or retention policies. You use them at your own risk.

15. Accuracy, No Professional Advice

Outputs may be inaccurate, incomplete, or inappropriate for certain contexts. GoTamil does not provide legal, medical, or other professional advice. You must review Outputs and exercise independent judgment.

16. Accuracy of Materials

The materials appearing on our Website and/or Software (including references, examples, screenshots, help articles, and marketing pages) are for general reference only and may not be complete, current, or free of errors. We do not warrant the accuracy, likely results, or reliability of any materials on the Services or on sites linked from the Services. Your use of such materials is at your own risk.

17. Support and Availability

We strive for high availability but do not guarantee uninterrupted service. Maintenance, updates, or network issues may cause downtime or latency. We do not offer enterprise plans or support SLAs at this time.

18. Copyright and Trademark Policy

We respect the intellectual property rights of others. If you believe content on the Services infringes your rights, notify us at [email protected] with:

  • Your contact details
  • Identification of the work claimed to be infringed
  • Identification of the material that is claimed to be infringing
  • A statement that you have a good-faith belief the use is not authorised
  • A statement that the information is accurate and, under penalty of perjury, you are authorised to act

We may remove or disable access to alleged infringing material and may terminate repeat infringers.

19. Feedback

If you send us feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without restriction, without any obligation to you.

20. Right to Terminate

We may, at our sole discretion, suspend or terminate your access to the Services immediately (with or without notice) if: (a) you breach these Terms or applicable law; (b) your use poses a security, legal, or reputational risk to us or others; (c) payment is overdue; or (d) we are required to do so by law or a governmental authority. Where permitted, we will provide notice via the Service or email.

You may terminate at any time by cancelling your subscription and ceasing use. Upon termination, you may not access your account. You should export or delete your content before cancellation where possible. We may retain certain records as required by law or to resolve disputes. Upon termination, the licences granted to you end, and you must stop using the Services. Sections that by their nature should survive (including ownership, confidentiality, IP, payment obligations accrued prior to termination, disclaimers, limitations of liability, indemnities, and dispute resolution) will survive termination.

21. Disclaimers

The Services and Outputs are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be error-free, secure, or meet your requirements.

22. Limitation of Liability

To the maximum extent permitted by law, in no event will GoTamil or its suppliers be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business interruption, arising from or related to your use of or inability to use the Services, even if advised of the possibility.

  • Cap on Liability. Our total aggregate liability for all claims arising out of or relating to the Services in any 12-month period is limited to the amounts you paid to GoTamil for the Services in the 12 months before the event giving rise to the liability.

Some jurisdictions do not allow certain limitations, so these may not apply to you.

23. Indemnification

You will defend, indemnify, and hold harmless GoTamil and its affiliates, officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses arising from your User Content, your misuse of the Services, or your violation of these Terms or applicable law.

24. Confidentiality

We treat User Content submitted through authenticated accounts as your confidential information. We will not disclose it to third parties except to provide the Services, comply with law, or with your consent. This obligation does not apply to information that is public, known to us without breach, independently developed, or rightfully obtained from another source.

25. Export Controls and Sanctions

You must not use the Services in violation of export control or sanctions laws. You represent that you are not located in, under the control of, or a national or resident of any restricted country or on any restricted list.

26. Communications

By creating an account, you may receive transactional emails and service announcements. You can opt out of non-essential marketing emails.

27. Modifications of Terms

We may review and amend these Terms at our sole discretion. If we make material changes, we will provide reasonable notice via the Services or email and update the “Last modified” date. Unless otherwise stated, changes take effect upon notice. Your continued use of the Services after changes take effect constitutes acceptance. If you do not agree to the amended Terms, you must stop using the Services.

28. Modifications to the Services and Software

We may modify, adapt, or change the Services (including features, user interface, availability of materials, and technical limits) at any time, including for security, performance, or legal reasons. We may do so without prior notice where commercially reasonable. You agree that we are not liable for such changes or any resulting temporary unavailability.

29. Governing Law and Dispute Resolution

Notice of Dispute (Informal Resolution)

Before filing a claim, you and GoTamil agree to try to resolve the dispute informally. A "Notice of Dispute" must be sent by the complaining party and include: (a) the sender’s name and contact information; (b) a description of the facts giving rise to the dispute; and (c) the specific relief requested. Send your Notice to [email protected]. We will send any Notice of Dispute to you at the email associated with your account. The parties will attempt to resolve the dispute through good-faith negotiations within 60 days from the date the Notice is sent. If the dispute is not resolved within 60 days, either party may pursue the claim as set out below.

Governing Law and Venue

These Terms are governed by the laws of India without regard to conflict of laws principles. The courts located in Chennai, Tamil Nadu, India will have exclusive jurisdiction, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.

If you are a consumer resident in the EU, UK, or a jurisdiction that mandates local consumer protections, you may have additional rights which prevail where required by law.

30. Miscellaneous

  • Entire Agreement. These Terms, the Privacy Policy, and any plan-specific terms are the entire agreement between you and us.
  • Assignment. You may not assign your rights without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Severance (Severability). If any provision is unenforceable, the rest remains in effect.
  • No Waiver. Failure to enforce any provision is not a waiver.
  • Translations. If we provide a translation of these Terms, the English version controls if there is a conflict.
  • Force Majeure. Neither party is liable for delays or failure to perform due to events beyond its reasonable control, including internet or utility failures, acts of God, labor disputes, governmental actions, and denial-of-service attacks.
